These are not horribly offensive "jokes" like Trevor Noah told about Aboriginal women. Growing up in Australia, there is a whole genre of jokes, called "Aboriginal jokes" where the "punch-line" is some horrific gruesome description of the death of an Aboriginal person or people.
These were (and apparently are) still shockingly mainstream. If you are an anti-racist you speak out when someone tells a joke like this, you don't joke about someone telling them, you certainly don't think it's a funny anecdote for the Ellen Show.

Good Question. They should have been. My clients would have been and legally there was sufficient basis to do it.
Does the answer rhyme with racism?
As background, so far a couple of the Proud Boys defendants have been charged w/ Attempt Gang Assault 1 (a felony) but some are only facing misdemeanor charges.
